Due to unavailability of ShowBox app in Play Store, many rose question whether ShowBox is safe and legal to stream in UK, Ireland, or other countries? This spreads all over the world and becomes the hot topic at the moment.

The UK implemented the Copyright Directive in 2003 (officially the Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonization of certain aspects of copyright and related rights in the information society).

On June 5, 2014, the Court of Justice of the EU (CJEU) ruled on a UK case Public Relations Consultants Association Ltd v Newspaper Licensing Agency Ltd et al found that:

…the copies on the user’s computer screen and the copies in the internet ‘cache’ of that computer’s hard disk, made by an end-user in the course of viewing a website, satisfy the conditions that those copies must be temporary, that they must be transient or incidental in nature and that they must constitute an integral and essential part of a technological process, as well as the conditions laid down in Article 5(5) of that directive, and that they may therefore be made without the authorisation of the copyright holders.

This can, and arguably should be read to state that streaming media content meets the Article 5(1) exception to the Article 2 reproduction right. Said differently, the Copyright Directive in Article 5(1) provides an exception to copyright protection – temporary files (the Directive calls them “acts”) which are transient and essential are not given copyright protection. The court ruled that files made during streaming are these types of files. Said even more differently, streaming copyrighted content is legal. Inasmuch as Showbox is streaming media, Showbox is legal, as per the report from StackExchange. Also, you can find more comments out there.

Q: I’m having second thoughts installing Showbox. Is it legal to watch/download?

A1: It is legal, although might be a gray area of unethical. copyright infringement would come into play by downloading and reposting for others to see. It is not illegal to view copyrighted material. It is illegal to download and post or sell.

A2: In short, no. It’s not allowed on the forums for copyright reasons. Streaming may be allowed, but downloading is not, regardless of intent to share, unless you pay for it. I’d steer clear of it to be safe.

Q: Whats the difference between streaming it and downloading it if the only way to watch it on a TV is to download it since I have an older android device and chrome-cast to the screen will not work on it?

A: You can almost look at it this way if you are not paying for its illegal (in most cases). When it comes to streaming and downloading: Streaming you are watching/listening to media on a device like a tablet that is being sent to you from another device such as a media server. Downloading you are keeping/saving the file a specific location to which you can do with it as you please – XDAdevelopers

Q: Is Showbox app Legal in India?

A: Currently in India, there is no specific regulator looking into the legality of applications or any official white or blacklist of applications. Hence not possible to declare it illegal. If anybody’s rights infracted or trampled by the app they may approach the court for appropriate action & remedy or security agencies as the situation may warrant.
